How long is a sentence for possession?

The sentence for possession is not as lengthy as other drug related offences. Yet, like other drug offences, the sentence for possession is dependent on the quantity of drugs found in your custody. The Drug Misuse and Trafficking Act 1985 (‘The Act’), under section 10, provides drug possession as an offence.

The maximum sentence for possession is two years imprisonment or a $2,200 fine.

If you are charged with possession, it is essential to seek legal advice to have the best chance of a defence. Generally, having the proper representation results in a lower sentence.
