What is the charge for assault?

The charge for Assault is split into two categories in NSW. Under the Crimes Act 1900 (NSW), Assault charges are broken into either:

  1. Common Assault or,
  2. Aggravated Assault

Common Assault is the lesser charge of the two, as the injuries sustained would be less significant than those for a charge of aggravated Assault.

A charge for aggravated Assault itself is then subdivided into several categories, with the wounds inflicted increasing the seriousness of the crime and punishment.
